В ожидании казни, его адвокаты пытались в своих самых последних апелляциях отменить ему либо дату казни, либо сам приговор, на том основании что Коул болен шизофренией, страдает от физического повреждения мозга, прикован к инвалидному креслу из-за неспособности ходить, едва может разговаривать, не понимает что его вообще казнят и годами не общается со своими адвокатами. Однако все суды отклонили эти аргументы из-за того что прокуратура и тюрьма предоставили доказательства обратного: показания о постоянных разговорах Коула с охранниками во время передачи еды в камеру; показания о разговорах между надзирателем тюрьмы и Коулом когда его переводили в другую камеру за месяц до казни; психологическая оценка в июле этого года, когда Коул разговаривал с психологом на протяжении двух с половиной часов, в ходе которого подтвердил что понимает за что и когда его собираются казнить. Помимо этого, суды так же признали нежелание Коула общаться со своими адвокатами как рациональный выбор, который не стоит расценивать как признак невменяемости. Слова Эйба явно не соответствуют описанию "едва может разговаривать"; и даже если общение было по переписке, то это означает что Коулу хватило психического состояния писать письма.
Но странно что тюремное бюро не упоминало о посетителях Коула, или то что он писал письма. Коул в инвалидной коляске на слушаниях 30 сентября этого года в окружном суде штата. Исчерпав все возможности для спасения, Бенджамина Коула наконец казнили 20 октября без каких-либо эксцессов, но примечательны две вещи: первая - по словам тюремщиков, Коул за несколько минут до казни раздумывал о том, чтобы пойти к каталке смерти самостоятельно на своих ногах, но в итоге решил что тюремщики повезут его в кресле, из чего можно понять что Коул мог ходить всё это время, и не нуждался в том чтобы его постоянно возили в кресле на все суды, как нынешние, так и прошлые; вторая - Коул непосредственно на каталке смерти две минуты говорил свои последние слова, что не подтверждает слова адвокатов о "едва может разговаривать" и "не понимает что его казнят", так как он отвечал надзирателю на вопросы "у вас есть последние слова перед казнью?

What a move. He did the 1972 Summit Series on radio. On TV, there was the 1976 game in Philadelphia when the Soviet Red Army players left the ice in protest at the Flyers take-no-prisoners tactics. He was there for the 2002 Olympic final in Salt Lake City when Canada ended its 50-year Olympic gold-medal drought with a win over the United States in the final. Not to mention a string of Stanley Cup finals. But Cole was more than hockey. Players, coaches and fans stood in appreciation to honour Cole in the second period as his four children, Christian, Hilary, Megan and Robbie, watched in the gondola at the Bell Centre. Cole, congratulations on 50 great years of hockey. He did 16 games his final season, up from the 10 originally planned. Bob Cole will always remain the soundtrack of hockey.
